Terms of Service

These Terms of Service ("Terms") govern your use of Small Business Analytics ("the Service"), operated by Small Business Analytics ("we," "us," or "our"). By signing up, you agree to these Terms.

1. The Service

Small Business Analytics provides website visitor analytics tools for small business owners. You may use the Service by installing our tracking script on your website and accessing your dashboard at app.smallbusinessanalytics.io.

2. Your Account

You are responsible for keeping your account credentials secure. You must be at least 18 years old to use the Service. One account per person or business entity.

3. Free Trial and Billing

All plans include a 7-day free trial. A valid payment method is required to start a trial. You will not be charged until the trial period ends. After 7 days, your selected plan will automatically begin billing monthly.

You may cancel at any time. If you cancel after your trial has converted to a paid plan, you will receive a prorated refund for the unused portion of your current billing period. No questions asked.

If your payment fails, we will notify you by email. Your account will be suspended if payment is not resolved within a reasonable period.

4. Plans and Limits

Each plan includes a monthly visitor limit:

• Starter — up to 10,000 visitors/month ($29/mo)
• Growth — up to 50,000 visitors/month ($49/mo)
• Scale — up to 200,000 visitors/month ($99/mo)
• Enterprise — up to 1,000,000 visitors/month ($199/mo)

If your site exceeds your plan's limit, we will notify you and prompt you to upgrade. We will not cut off your service without notice.

You may upgrade or downgrade your plan at any time through the billing portal.

5. Acceptable Use

You agree not to:

• Use the Service to track websites you do not own or have permission to track
• Attempt to access other customers' data
• Reverse engineer, copy, or resell the Service
• Use the Service for any illegal purpose
• Artificially inflate traffic numbers to circumvent plan limits

6. Your Data

You own your analytics data. We store it securely and use it only to provide the Service to you. We do not sell your data or your visitors' data. See our Privacy Policy for full details.

7. Your Visitors' Privacy

You are responsible for complying with applicable privacy laws (such as GDPR or CCPA) regarding the tracking of your own website visitors. You must disclose the use of analytics tracking in your own privacy policy. Our tracking script does not use cookies but does use localStorage.

8. Uptime and Reliability

We strive to keep the Service available and reliable, but we do not guarantee 100% uptime. We are not liable for any losses caused by Service unavailability or data errors.

9. Termination

You may cancel your account at any time through the billing portal or by emailing support@smallbusinessanalytics.io. We may suspend or terminate accounts that violate these Terms.

Upon cancellation, your data will be retained for 30 days before deletion, during which time you may request an export.

10. Limitation of Liability

The Service is provided "as is." To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you for any claim will not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles.
